Administrative Law is a Unique Area of the Law

The Administrative Law Process
The first step is to provide a written response after an accusation has been filed against you. In fact, strict time limits apply to filing a response. Under some circumstances a failure to file a timely response can result in a denial of your right to a hearing. Immediately after filing a response a request for discovery should be made so that you can obtain all the evidence the board has against you. This is just the beginning.
There will be an investigation stage. Should you subpoena additional records? Should you obtain an order permitting the deposition of parties and witnesses? These are questions that must be addressed strategically.
Even before an accusation is filed you may be asked to give a statement and cooperate with an investigator. This may pose a dilemma as you may have some statutory obligations to cooperate but you also may have an overriding constitutional right to remain silent if criminal activity is suspected.
